BarberScanner Terms of Service

These Terms of Service ("Terms") govern your use of BarberScanner, including our mobile applications, website, and related services (collectively, the "Service").

By accessing or using BarberScanner, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

BarberScanner is a platform that helps clients discover barbers, schedule appointments, manage bookings, and access related services.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use BarberScanner.

By using the Service, you represent that:

• You have the legal capacity to enter into these Terms.
• The information you provide is accurate.
• You will comply with applicable laws.

Certain features require an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Keeping your account information accurate and up to date.

You agree not to:

• Share your account with others.
• Impersonate another person or business.
• Attempt unauthorized access to other accounts or systems.

We may suspend or terminate accounts that violate these Terms.

Barbers and shop owners are responsible for:

• Providing accurate business information.
• Maintaining service availability and pricing.
• Complying with applicable licensing and regulatory requirements.
• Ensuring that content uploaded to BarberScanner belongs to them or is properly licensed.

BarberScanner does not verify every qualification, license, or certification provided by barbers. Clients should independently evaluate services before booking.

BarberScanner provides booking technology but is not a party to the service agreement between a barber and a client.

BarberScanner:

• Does not perform barber services.
• Does not guarantee appointment availability.
• Does not guarantee the quality of services provided by any barber.

Any disputes regarding services, appointment outcomes, or pricing should first be addressed directly between the client and barber.

Cancellation policies may vary between barbers. Users are responsible for reviewing cancellation rules before booking.

BarberScanner is not responsible for:

• Cancellation fees imposed by barbers.
• Missed appointments.
• No-shows.
• Scheduling conflicts caused by users.

Certain features may require a paid subscription.

Subscriptions may include:

• BarberScanner Pro
• Future premium plans and add-ons

Subscription details, pricing, and billing periods are displayed before purchase.

If you purchase an auto-renewable subscription through the Apple App Store or Paddle:

• Payment will be charged to your account upon confirmation.
• Subscriptions automatically renew unless canceled before the renewal period.
• Renewal charges occur according to the subscription plan selected.

You may manage subscriptions through:

• Apple ID Settings (for iOS purchases)
• Your Paddle billing dashboard or via the link provided in your email receipt (for web purchases)

Deleting the app does not cancel a subscription.

Purchases made through:

BarberScanner cannot directly issue refunds for purchases processed by Apple or Paddle without going through their respective platforms.

Users may submit:

• Profile photos
• Barber portfolios
• Shop images
• Reviews
• Business descriptions
• Other content

You retain ownership of your content. However, by uploading content, you grant BarberScanner a worldwide, non-exclusive, royalty-free license to:

• Display
• Host
• Store
• Reproduce
• Distribute

the content solely for operating and improving the Service. You represent that you have the rights necessary to upload such content.

You agree not to:

• Violate laws or regulations.
• Upload harmful, illegal, or offensive content.
• Harass other users.
• Interfere with platform security.
• Attempt unauthorized access.
• Reverse engineer the Service.
• Use automated scraping or bots without permission.

We may remove content or suspend accounts for violations.

BarberScanner, its trademarks, branding, software, designs, and content are owned by Marrakech New Challenge SARL or its licensors.

Nothing in these Terms grants ownership rights to users. You may not copy, distribute, modify, or exploit our intellectual property without written permission.

The Service may integrate with:

• Apple
• Paddle
• RevenueCat
• Railway
• Email providers
• Analytics providers
• Payment providers

We are not responsible for third-party services or their availability. Your use of those services may be subject to separate terms.

We strive to provide uninterrupted service but do not guarantee:

• Continuous availability
• Error-free operation
• Permanent access

The Service may be modified, suspended, or discontinued at any time.

The Service is provided "AS IS" and "AS AVAILABLE."

To the maximum extent permitted by law, BarberScanner disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee:

• Booking success
• Barber performance
• User conduct
• Service quality

To the maximum extent permitted by law, Marrakech New Challenge SARL shall not be liable for:

• Indirect damages
• Lost profits
• Lost business opportunities
• Data loss
• Appointment disputes
• Service dissatisfaction

Our total liability shall not exceed the amount paid by you to us.
